How does bail work?
Bail is a legal process where you can be temporarily released from the State’s custody. After being released on bail, you will need to present your defence in Court. There are three types of bail proceedings being Police bail, Prosecutor bail and bail in open court.
Types of bail applications
Police bail
Section 59 of the Criminal Procedure Act, 51 of 1977 allows for Police bail. This is usually for less serious offences where you may be released from custody before your first court appearance.
Prosecutor bail
Section 59A of the Criminal Procedure Act, 51 of 1977 allows a prosecutor to release you on bail before their first court appearance.
