What is a correspondent attorney?
A correspondent attorney acts as a legal representative on behalf of an instructing attorney who is located outside the jurisdiction of a specific court. A correspondent attorney should be located within a radius of 25 kilometres from the Court House.
When should a correspondent attorney be appointed?
A correspondent attorney should be appointed if the address of the attorney is more than 25 kilometres from the Courthouse. This is in accordance with Rule 5(3)(a)(i) and Rule 55(1)(e)(i) of the Magistrates’ Court Rules (GNR 6752 in G. 53572 effective from 28 November 2025) and Rule 6(5)(b)(i) and Rule 17(3)(a) of the Uniform Rules of Court (GNR 3397 in G. 48571 effective from 19 June 2023).
What does a correspondent attorney do?
Correspondent attorneys play a crucial role in the legal process by streamlining service and filing. They handle all necessary paperwork, from issuing a summons and notice of motion. They are familiar with the regulations and practices by a specific court in which jurisdiction they are. Correspondent attorneys ensure that your legal documents are issued, served and filed at court in a timely manner.
What is a magisterial district?
South Africa is subdivided into different provinces and each province is further subdivided into magisterial districts, the area of jurisdiction of a district court. South African Courts have a three-tier structure namely: district, regional and high court.
Why is it necessary to appoint a correspondent attorney?
If a client needs to issue summons or an application and the address of the instructing attorney is not within 25 kilometers from the court where the summons or application needs to be issued, the attorney need to appoint a correspondent attorney to carry out the instructions of an instructing attorney.
What is Party-and-party costs?
Party and party costs are limited by specific tariffs set by the Rules Board for Courts of Law. These tariffs are designed to keep recoverable costs within reasonable limits. As a result, the winning party often doesn’t recover all of their actual legal costs.
Can you recover all your legal costs from an unsuccessful party?
No, you can only claim the reasonable legal costs on a party and party during taxation which the taxing master allows. The costs that can be recovered from an unsuccessful party is based on a party and party scale which is limited by specific tariffs set by the Rules board of Courts of Law.
What is a taxing master in South Africa?
A taxing master is a judicial officer of the court that is competent to tax a bill of costs for litigious work that was performed by an attorney.
What are the duties of a correspondent attorney?
They should handle a matter with the same level of care, skill, professionalism and urgency as the instructing attorney would.
The correspondent attorney strictly works on the instructions of an instructing attorney.
Who pays a correspondent attorney?
The instructing attorney is responsible for the fees and expenses incurred by the correspondent attorney. This includes reimbursing the correspondent attorney and, if necessary, collecting payment from the client.
